On Monday, U.S. technology firm InterDigital and a patent licensing platform won their bid to dismiss Tesla’s London lawsuit seeking a patent license ahead of its 5G car launch in Britain
The business owned by Elon Musk filed a lawsuit against InterDigital and Avanci in 2023 at the High Court in London.
Avanci is a corporation that licenses patents from numerous owners, mainly for automotive applications.
To decide the conditions of a license that would allow Tesla to use patents that are owned by patent holders, including InterDigital, and which are licensed by Avanci, Tesla requested that the court determine the terms of the license that are fair, reasonable and non-discriminatory (FRAND).
The attorneys for Tesla stated in court documents that the business “plans imminently to launch 5G vehicles in the UK” in preparation for a hearing that will take place in May.
On the other hand, InterDigital and Avanci submitted a motion to the court requesting that it dismiss Tesla’s request for a determination on FRAND terms for a license.
On Monday, the High Court issued a favorable verdict to them. Judge Timothy Fancourt stated in a written ruling that Tesla’s application for a license must be rejected but that Tesla’s claim to revoke three of InterDigital’s patents can proceed.
